Status Portal for Azure DevOps — License & Terms of Service

1. Acceptance

By installing or using Status Portal (“the Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not install or use the Service. These Terms are between you (or your organization) and Baytek Software (“Baytek”).

2. The Service

Status Portal is an Azure DevOps extension and companion hosted backend that lets an organization declare incidents and maintenance windows from inside Azure DevOps and publish a branded public status page. The Service also delivers opt-in subscriber email notifications when subscribed-to events change state.

3. License Grant

Subject to these Terms, Baytek grants you a worldwide, non-exclusive, non-transferable, non-sublicensable license to install and use Status Portal within Azure DevOps organizations you administer, for your internal business purposes and to communicate service health to your end users.

4. Pricing during launch

Status Portal is offered free of charge during its launch phase. Baytek may introduce paid tiers or premium capabilities in the future; in that case, the features available to your installation on the day of pricing changes will remain available under the existing tier (free or otherwise) until the start of the next renewal period or such other notice period as Baytek provides in writing (no less than 30 days).

5. Subscriber communications

  • Subscriber email addresses are collected only with the subscriber's opt-in via the public status page or a self-service subscribe widget
  • Every notification email includes a one-click unsubscribe link
  • Status Portal sends only transactional notifications related to incidents and maintenance windows the subscriber chose to follow. Status Portal does not send marketing emails to subscribers
  • You are responsible for ensuring that subscriber data is collected and used in compliance with applicable law (including GDPR / UK GDPR / CCPA), and that your organisation's own privacy policy is consistent with this practice

6. Restrictions

You may not:

  • Reverse engineer, decompile, or disassemble the Service, except where permitted by applicable law
  • Redistribute, sublicense, resell, or rebrand the Service as your own product
  • Use the Service to send unsolicited or marketing email
  • Upload incident or maintenance content that is unlawful, defamatory, or violates third-party rights
  • Use the Service in a way that interferes with its availability for other customers (e.g. abusive API usage)
  • Use the Service in violation of applicable law or Microsoft's Marketplace terms

7. Customer Responsibilities

  • You control installation, configuration, role assignment, and removal in your Azure DevOps organization
  • You are responsible for the accuracy of incident, maintenance, and component status content you publish
  • If you connect a custom domain, you are responsible for the DNS configuration and certificate ownership
  • You are responsible for ensuring your use complies with applicable law, your internal policies, and Microsoft Azure DevOps terms

8. Service Availability

Baytek aims to keep the Service and the hosted public status page available, but does not guarantee uptime during the free launch phase. Status Portal's own availability is published at https://status.baytekdev.com/. Planned maintenance for the Service itself will be announced on that page where reasonably practicable.

9. Data and Privacy

Use of the Service is also governed by the Status Portal Privacy Policy. The Service stores incident, maintenance, branding, and subscriber data on Baytek-hosted infrastructure as described there.

10. Updates

We may publish updates to the Azure DevOps extension and the hosted backend to fix bugs, address security issues, or add features. Extension updates are distributed through the Visual Studio Marketplace; auto-update behavior is controlled by your Azure DevOps organization settings. Backend updates are deployed continuously.

11. Intellectual Property

The Service, including its source code, design, documentation, and branding, is the intellectual property of Baytek Software. All rights not expressly granted in these Terms are reserved. Trademarks belong to their respective owners.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, or that every subscriber notification will be delivered, since deliverability depends on third-party mail systems.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAYTEK SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE. While the Service is offered free of charge, Baytek's total liability for the Service shall not exceed USD $50. Once paid tiers are introduced, total liability for paying customers shall not exceed the amount paid for the Service in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Baytek Software from any claims, damages, or expenses arising from incident, maintenance, or subscriber content you publish through the Service, your violation of these Terms, or your violation of any third-party rights.

15. Termination

  • You may stop using the Service at any time by uninstalling the extension
  • We may terminate or suspend access if you materially violate these Terms
  • On uninstall, the organisation's data is retained for 30 days to allow recovery, then deleted, as described in the Privacy Policy

16. Governing Law

These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the state and federal courts located in California, USA, subject to applicable law.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

18. Changes to These Terms

We may update these Terms. Material changes will be reflected in the “Last updated” date above and, where required by law or where pricing changes, communicated to the billing contact at least 30 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance.

19. Entire Agreement

These Terms, together with the Status Portal Privacy Policy and the Microsoft Visual Studio Marketplace Terms of Use, constitute the entire agreement between you and Baytek Software regarding Status Portal.
