Baytek Sprint Analytics — Terms of Service

1. Acceptance of Terms

By installing or using Baytek Sprint Analytics (“the App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not install or use the App. These Terms are between you (or your organization) and Baytek Software (“we”, “us”, “our”).

2. Description of Service

The App is a Jira Cloud add-on that provides sprint analytics, flow metrics, aging charts, forecasting, and team performance views. The App is delivered through the Atlassian Forge platform and operates entirely within the Atlassian Cloud environment.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms and the Atlassian Marketplace Terms of Use. This license is subject to:

  • Your valid Atlassian Jira Cloud subscription
  • Your compliance with these Terms
  • Payment of applicable fees, if any, as listed on the Marketplace

4. Permitted Use

You may:

  • Install the App on Jira Cloud instances you administer
  • Use the App for your organization's internal business purposes
  • Configure workflow mappings and integration settings

You may not:

  • Reverse engineer, decompile, or disassemble the App
  • Redistribute, sublicense, or resell the App
  • Use the App to develop a competing product
  • Attempt to circumvent licensing or access controls
  • Use the App in violation of applicable law or Atlassian's terms

5. Data and Privacy

Your use of the App is also governed by our Privacy Policy. The App accesses Jira data in read-only mode and stores minimal configuration data within Atlassian Forge infrastructure. We do not access, store, or transmit your data outside of the Atlassian environment.

6. Availability and Support

  • The App is provided “as available” on the Atlassian Forge platform
  • Availability depends on Atlassian infrastructure uptime
  • We provide best-effort support via support@baytekdev.com
  • We aim to respond to support requests within 2 business days
  • Critical bug fixes are prioritized; feature requests are considered but not guaranteed

7. Updates

We may update the App from time to time to:

  • Fix bugs or security issues
  • Add new features or improve existing ones
  • Maintain compatibility with Atlassian platform changes

Updates are deployed automatically through Atlassian Forge.

8. Intellectual Property

The App, including its source code, design, documentation, and branding, is the intellectual property of Baytek Software. All rights not expressly granted in these Terms are reserved.

9. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Analytics results will be 100% accurate, since they depend on Jira data quality
  • The App will meet all of your specific requirements
  • Monte Carlo forecasts represent guaranteed delivery dates

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAYTEK SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Baytek Software from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Termination

  • You may stop using the App at any time by uninstalling it
  • We may terminate or suspend access if you violate these Terms
  • Upon termination, stored configuration data is deleted from Forge KVS

13. Governing Law

These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the courts located in California, USA, subject to applicable law.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and the Atlassian Marketplace Terms of Use, constitute the entire agreement between you and Baytek Software regarding the App.
